This Acceptable Use Policy ("AUP") governs your use of Prodarchy and is incorporated into, and forms part of, the Prodarchy Terms of Service at https://prodarchy.com/legal/terms. Violation of this AUP is a material breach of the Terms of Service and may result in suspension or termination under Sections 74–75 of the Terms of Service.
1. Purpose
This AUP exists to keep Prodarchy secure, reliable, and compliant with the policies of the third-party marketplaces and AI providers it integrates with. It sets out what you may and may not do with the Services, your Account, Customer Data, the API, and any Marketplace connection made through Prodarchy.
2. Scope
This AUP applies to all Users, Workspace Administrators, Authorized Users, agencies acting on behalf of clients, and any person or system accessing Prodarchy through the web application, mobile access, or the API.
3. General Prohibited Uses
You must not use Prodarchy to: violate any applicable law or regulation; infringe another party's intellectual property, privacy, or other rights; upload, generate, or distribute malware or malicious code; conduct fraud, phishing, or impersonation; obtain unauthorized access to any account, system, or data; interfere with or disrupt the integrity or performance of the Services or underlying infrastructure; circumvent authentication, rate limits, or usage restrictions; scrape or bulk-extract the Services outside of authorized API use; resell or sublicense access without authorization; manipulate usage metrics or AI credit consumption; or use automation to exceed Plan limits.
A more detailed list of prohibited uses is set out in Section 43 of the Terms of Service, which this AUP supplements.
4. Marketplace API Usage Restrictions
Where you connect a Marketplace account to Prodarchy (including via Amazon's Selling Partner API or Flipkart's seller APIs), you agree that:
- Data retrieved through a Marketplace's API may only be used for the purposes that Marketplace's own developer or API terms permit (for example, Amazon-sourced data is subject to Amazon's Acceptable Use Policy and API license terms, which restrict use of Amazon data to servicing your own Amazon seller account and prohibit uses such as building a competing catalog for unrelated third parties without authorization, or retaining certain order/customer data longer than permitted);
- You will not use Prodarchy to aggregate, resell, or repurpose Marketplace API data in a way that violates the connected Marketplace's terms;
- You will not attempt to use Prodarchy to circumvent a Marketplace's own rate limits, throttling, or fair-use restrictions;
- You are responsible for maintaining your own valid authorization (seller account standing, API access grant) with each connected Marketplace, and for promptly revoking Prodarchy's access if that authorization ends;
- Prodarchy may suspend a Marketplace connection where continued access creates a risk to Prodarchy's own standing with that Marketplace's developer program.
5. AI Feature Acceptable Use
When using Sift AI-assisted catalog generation, enrichment, or extraction features, you must not: submit content intended to generate deceptive, fraudulent, or materially false product claims (including false certifications, safety claims, or performance claims); attempt to extract, reconstruct, or reverse engineer underlying AI prompts, model weights, or proprietary workflows; use generated output to create prohibited content described in Section 6 below; or use the AI features to generate content for products that are themselves illegal to sell, advertise, or list on the intended Marketplace.
You remain responsible for human review of AI Output before publication, as described in Sections 22–26 of the Terms of Service.
6. Prohibited Content
You must not upload, generate, or publish through Prodarchy any content that: is unlawful in the jurisdiction where it will be used or published; infringes copyright, trademark, or other intellectual-property rights you do not hold or have not licensed; contains another person's personal data that you are not authorized to process (including stolen personal data, government identification, or payment-card information); relates to counterfeit, stolen, or illegal goods; makes fraudulent, deceptive, or unsubstantiated product claims; contains malware or exploit code; or promotes violence, hatred, or discrimination.
7. Data Upload Restrictions
You must not upload to Prodarchy: credentials, private keys, API secrets, or payment credentials outside a Service's designated secure integration mechanism; sensitive personal data (health records, biometric data, government ID numbers) within catalog fields or file uploads, as described in our Privacy Policy at https://prodarchy.com/legal/privacy; or data you obtained through hacking, unauthorized scraping, or another unlawful means.
8. Account and API Security Obligations
You must protect your Account credentials and API keys as described in Section 10 of the Terms of Service, use API access only within documented rate limits, and promptly notify Prodarchy of any suspected credential compromise, unauthorized access, or abuse of your Account using the contact details in Section 12.
9. Security Testing
You must not perform penetration testing, automated vulnerability scanning, denial-of-service testing, or other security testing against Prodarchy infrastructure without prior written authorization. Good-faith vulnerability reports are welcomed through the responsible-disclosure channel in Section 12.
10. Agency and Multi-Client Use
If you use Prodarchy on behalf of multiple clients under an Agency Plan, you are responsible for ensuring each client's data is used only within that client's own authorization, that client Workspaces are not cross-contaminated without permission, and that your own agreements with clients permit the processing you carry out through Prodarchy, consistent with Section 98 of the Terms of Service.
11. Enforcement
Violations of this AUP may result in, depending on severity: a warning and request to remedy the violation; temporary restriction of the affected feature or Marketplace connection; suspension of the Account under Section 74 of the Terms of Service; or termination under Section 75 of the Terms of Service. Prodarchy may take immediate action without prior notice where a violation creates significant security, legal, or third-party (including Marketplace API standing) risk.
12. Reporting Violations and Security Issues
To report a suspected violation of this AUP, or a security vulnerability, contact:
Abuse / policy violations: [INSERT ABUSE/SUPPORT EMAIL]
Security disclosures: [INSERT SECURITY EMAIL]
13. Changes to This Policy
We may update this AUP from time to time, particularly as Marketplace API terms evolve. Material changes will be communicated as described in Section 90 of the Terms of Service.
Schedule — Completion Checklist
Before publishing: insert abuse and security contact emails; confirm current Amazon SP-API and Flipkart API developer-terms obligations with each Marketplace's latest published policy at the time of production launch, since these terms change independently of Prodarchy; and have this Policy reviewed alongside the Terms of Service by qualified counsel.
